Ethnocare ("Ethnocare Inc") offers, and you have an interest in using and benefitting from, Ethnocare’s eCommerce portion of its website (“Service”). These eCommerce Terms of Use ("Terms of Use") establish the rules for Ethnocare authorized customers (“Users”) to use the Service. In order to use the Service, you should have already observed and agreed to the Ethnocare Web Site Terms of Use and to the Ethnocare Shop Privacy Notice, as the terms of both of those documents are incorporated into these Terms of Use.

These Terms of Use were made effective on October 8, 2023 and may change at any time at Ethnocare’s discretion, so please review the Terms of Use each time you visit this website. These Terms of Use are applicable to you when you access the website, which may include, but is not limited to, completing the shopping process.

SERVICE REQUIREMENTS

You must be legally able to use this Service in the jurisdictions where you reside, which may include, but is not limited to, being duly authorized to prescribe, purchase and fit Ethnocare products in such jurisdictions. You may not use the Service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.

ORDER PROCESS

When you purchase an Ethnocare product through the Service (ecommerce), you shall order by filling and submitting an order through our shopping cart and checkout. Ethnocare shall accept or reject such order within ten (10) days. Each accepted order shall be deemed to become incorporated herein by reference as if attached and made an integral part of these Terms of Use. Additionally, terms, provisions or conditions on any purchase order, acknowledgement, or other business form or writing that you may provide to Ethnocare or use in connection with the procurement of products or services from Ethnocare will not affect the rights, duties or obligations of the parties using the Service.

GENERAL AND SUPPORT CONDITIONS

Technical support is only provided to paying account holders in good credit standing with Ethnocare. Ethnocare shall only provide technical support via telephone. Such transmissions may occur over various networks and may change to conform and adapt to technical requirements of connecting networks or devices. You expressly understand the limitations of liability you agreed to in our Website Terms of Use. Your use of the Service is at your sole risk, and Ethnocare does not warrant that the Service will be uninterrupted, timely, secure, error-free or otherwise guarantee that it will operate as you intend.

ETHNOCARE RIGHTS

Ethnocare reserves the right to modify, terminate or refuse service to you or anyone for any reason, without notice at any time. We reserve the right to provide the Service to your competitors and make no promise of exclusivity in any particular market segment or geography. In the event of a dispute or disagreement over the use of the Service or your account, we reserve the right to (a) request, and you agree to provide, documentation or information from you or your account necessary to confirm circumstances and (b) temporarily disable an account until resolution is determined.

ETHNOCARE EXCLUSIVE PROPERTY

All contents, information, documents, images and illustrations published on this website ("Content") are the property of Ethnocare. You agree not to reproduce, duplicate, copy, sell, resell or explain any portion of the Service without the express written permission by Ethnocare. Note that the text and image materials used may also be protected under copyright law. Moreover, many Ethnocare products are also protected under patent law, design law or represent other intellectual property rights. The granting of access to this Content does not create any rights thereto. The download of Content is permitted only if the Content is provided expressly for such purpose. Content shall not be used commercially, modified, shared with a third party, duplicated, disseminated or published in any form without prior written consent. If you wish to use Content, please contact our Customer Service. The products shown and recommendations on product combinations represent fitting examples and a selection of Ethnocare products. No statements are made about any other products.

Whether a product is actually suitable for you and whether you are capable of exploiting the functionality of the product to its fullest depends on many different factors. Amongst others, your physical condition, fitness and a detailed medical examination are key. PURCHASE TERMS

You acknowledge and agree that the Service merely enables the online purchasing of Ethnocare products that you or your account currently has authority and ability to purchase. You agree that Ethnocare’s general purchase Terms of Sale apply to all purchases made through the Service, including but not limited to payment, shipment, return and product warranty terms. To the extent that specific Ethnocare selling entities or groups have special or exclusions to those standard purchase terms, they can be found on our Returns Policy Page, and purchases of those applicable products through the Service shall incorporate those special terms and conditions.

CANCELLATION

You may cancel your order before shipment by contacting Ethnocare at 1-418-934-5669 and then following the specific instructions indicated to you in Ethnocare’s response. Upon cancellation, Ethnocare shall ship, and you shall acknowledge acceptance of, any and all orders processed through the Service at any time prior to your cancellation.

REQUIRED NOTICES

It’s our policy to respond to notices of alleged copyright infringement. If you believe Ethnocare or one of its users is infringing your copyright, please provide written notice to Ethnocare.

THIRD-PARTY SERVICES

In general, third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

DISPUTE RESOLUTION

Any controversy or claim arising out of or relating to these Terms of Use, or the breach thereof, shall be settled by arbitration administered by the Canadian Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The venue for such arbitration shall be in the Province of Quebec.

LIMITATION OF LIABILITY

In no event shall Ethnocare or its officers, directors, employees or agents be liable for any indirect, punitive, special, incidental or consequential damages in connection with or arising out of these Terms of Use (including loss of business, revenue, profits, use, data or other economic advantage), however they arise, whether in breach of contract or in tort, even if they have been previously advised of the possibility of such damage. You agree that Ethnocare’s maximum aggregate liability for all claims arising out of or relating to these Terms of Use shall not exceed the amount you have paid to Ethnocare in the last twelve (12) months.

CONSENT

By accessing or using any part of the Service, you agree to be bound by these Terms of Use and to the collection and use of your information as set forth in the Ethnocare Shop Privacy Notice. If you do not agree to all the terms and conditions of these Terms of Use, then you may not use the Service.

SEVERABILITY

If any provision of these Terms of Use is held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

GOVERNING LAW

These Terms of Use and any dispute arising out of or related to it will be governed by and construed in accordance with the laws of the Province of Quebec, without regard to its conflict of laws principles.
